加州豁免若干類兒童家具的可燃性規定(英文版)

  The California Bureau of Electronic and Appliance Repair, Home Furnishings and Thermal Insulation recently amended Section 1374.2, Title 4, Article 13 of the California Code of Regulations to exempt strollers, infant carriers and nursing pillows from the requirements of Technical Bulletin 117 (Requirements, Test Procedures and Apparatus for Testing the Flame Retardance of Filling Materials Used in Upholstered Furniture), which sets flammability standards for upholstered furniture. The Bureau also eliminated a reference in the regulations to articles manufactured solely for recreational use or physical fitness purposes since these items are not included in the definition of upholstered furniture and are thus not subject to TB 117.

  Since 1975, all upholstered furniture sold in California has been required to comply with the flammability requirements of TB 117 or a similar standard. This standard applies to all filling materials contained in any article of upholstered furniture as well as all filling materials added to re-upholstered furniture. Excluded from this requirement are the following articles of upholstered furniture other than furniture used in facilities designed for the care or treatment of humans: (i) cushions and pads intended solely for outdoor use; (ii) any article which is smooth surfaced and contains no more than one-half inch of filling material, provided that such article does not have a horizontal surface meeting a vertical surface; and (iii) strollers, infant carriers and nursing pillows.

  In making its determination to exclude strollers, infant carriers and nursing pillows from the requirements of TB 117, the Bureau found that most of these products contain a much lesser amount of resilient filling materials (e.g., foam, batting) than average adult seating furniture. Moreover, most of these items contain little or no polyurethane foams, which are often the most flammable component of upholstered seating furniture. The Bureau observes that in many instances nearly all inside filling materials contained in these products are comprised of synthetic batting that passes TB 117 without the need for any fire retardant treatments. Accordingly, the Bureau believes that these juvenile products will not cause or sustain a large fire if ignited with a small open flame, which could be comparable to the size of a match or charcoal lighter flame. The Bureau is also of the opinion that these products are less likely to be ignited under the exercise of great care and supervision of adults.

  The Bureau advises that the three products that are being exempted from TB 117 must continue to comply with the Bureau's licensing and labelling requirements and indicates that its inspectors will continue to examine them for proper labelling and listing of component materials.
